沉默权现已成为国际人权法确认的一项基本人权,在已经或即将对我国生效的一些国际公约或其他规范性文件中有明确的规定,是否赋予犯罪嫌疑人,被告人以沉默权成为我国法律界、司法界一个竞相争论的问题。本文仅从沉默权的产生和发展、内涵及其法律移植等基本法律问题加以探讨,主张对沉默权采取客观辩证的态度,既不可拒之门外,也不可立时全盘接受。
Right to silence has now become a basic human right recognized by international human rights law. It has clear stipulations in some international conventions or other normative documents that have been or are about to enter into force for our country. Does it give suspects and defendants the right to silence as our country? The legal profession, the judiciary a competing issue. This article only discusses the basic legal issues such as the emergence and development of the right to silence, its connotation, and its legal transplantation. It advocates that an objective and dialectical attitude toward the right to silence should be neither disclaim nor accepted immediately.
