海运履约方制度适应当代门到门运输,其与承运人有同样的责任限制权和抗辩权,加入港口经营人为其调整。我国的海商法中目前存在着实际承运人的概念不清楚,港口经营人的法律地位很不明确。本文结合了鹿特丹规则,对我国应该如何构建适合我国国情的海运履约方进行分析,更好的促进我国海上贸易发展。
The maritime performing party system adapts to contemporary door-to-door transport and has the same limitation of liability and right of defense as the carrier, adding to the port operator for adjustment. The current concept of carrier in maritime law in our country is unclear. The legal status of port operators is not clear. This article combines the Rotterdam rules, analyzes how to build a maritime performing party that suits our national conditions and how to better promote the development of maritime trade in our country.
