教育纠纷的复杂性与司法审查自身的缺陷,都要求教育纠纷解决机制的不断创新性,以解决教育的现实问题。教育仲裁制度的重构能充分发挥作为专家型中立人的专业优势,以非对抗的方式解决纠纷。通过优化教育仲裁委员会的组成,设计学术实体性纠纷仲裁终局性裁定等来完善教育仲裁制度,弥补单一诉讼模式的缺陷。
The complexity of educational disputes and the defects of judicial review require the continuous innovation of the educational dispute resolution mechanism to solve the practical problems of education. The reconstruction of the educational arbitration system can give full play to its professional advantages as an expert neutral and solve the disputes in a non-confrontational way. By optimizing the composition of the educational arbitration commission and designing the final arbitration adjudication of academic substantive disputes, the educational arbitration system should be improved to make up for the shortcomings of the single lawsuit model.
