法制化就是将行为纳入到法律规制的范畴,由相应的制度对其进行规定和制约,使其规范化、程序化。在我国全面法制化建设的大背景下,教育评估法制化建设正面临着前所未有的机遇和挑战,以法律视角审视教育评估行为已逐渐进入我国相关学者的研究领域。实现教育评估法制化不仅是与国际接轨的需要,是管办评分离的需要,是依法治教的需要,也是评估公信力的需要。有法可依是教育评估法制化的根本前提,可以最大限度地避免教育评估活动中人的因素的影响,避免人情评估、暗箱操作、滥用权力等现象的发生;依法评估是教育评估法制化的实现依据,它需要体现在教育评估前、中、后等一个完整的教育评估活动的各个节点;法治精神则是教育评估法制化建设的有力支撑,它是社会主义核心价值观的重要组成部分。从外部而言,法治必须有铁一般的制度文本;从内部而言,法治必须倚重人的心理秩序。在教育评估活动中,法治精神体现在两个方面,即评估法制观念的培育和遵从与评估从业人员的职业化追求。

Examining the educational evaluation behavior from a legal perspective has gradually entered the research fields of relevant scholars in our country. Realizing the legalization of educational assessment is not only the need of keeping in line with the international standards, but also the need of separation of management from appraisal, the need of administering education according to law and the need of assessing credibility. The law can be based on legal evaluation of education is the fundamental premise, to the maximum extent possible to avoid the impact of human factors in educational assessment activities, to avoid the assessment of human feelings, secret operations, the abuse of power and so on; legal assessment is the legalization of education assessment To achieve the basis, it needs to be reflected in each node of a complete education evaluation activity before, during, and after the education evaluation. The spirit of the rule of law is a powerful support for the legal construction of education evaluation. It is an important part of the socialist core values. From the outside, the rule of law must have ironclad system texts; from the inside, the rule of law must rely on human psychological order. In educational evaluation activities, the spirit of the rule of law is reflected in two aspects, namely, the evaluation of the cultivation of legal concepts and the compliance and evaluation of the professional pursuit of practitioners.
