流域环境纠纷解决机制构建必须以流域生态系统的自然特性为逻辑起点,以生态整体主义、生态系统管理、公共利益理论为理论依据。针对我国现行环境纠纷解决机制割裂流域生态系统的整体性、审判权缺位、公益诉讼机制缺失等弊端,我国应在充分尊重流域生态系统的自然特性,遵循环境纠纷解决机制的国际发展趋势的基础上,构建统一、权威的流域纠纷行政处理机构和专门化的流域司法机构,在流域层面上建构一个以流域环境公益保护为目标、执行权和监督权相制约、行政权与司法权相协调的多元纠纷解决机制。
