民诉法修正案草案第122条作出了先行调解的规定,但是该条内容较简陋,没有规定适宜调解的案件范围,却强调调解的当事人自治原则,有可能使该条形同虚设,使本该强制调解的案件得不到调解。强制调解具有的分流案件、减轻司法负担的功能使其具有构建的必要性,我国设立强制调解制度已有实践和政策支持。适宜强制调解的案件范围应借鉴域外之经验,应适用于因长期性、综合性社会关系发生的纠纷以及有着保守个人隐私和商业秘密需要的案件。目前采取的强制委托条件、协作调解与法院调解均可采取,但要注意在诉前强制委托调解时保障当事人的诉权。
Article 122 of the Civil Procedure Law Amendment provides for the first mediation. However, the article is rather crude and does not stipulate the scope for mediation.
