工会依法维权具有法律和政策依据,但当前情况下,市、区、县总工会面临帮助职工依法维权的困境,在解决问题的过程中,以法律为依据,因地制宜,根据具体情况摸索出与案情、省情相一致的维权模式。取得维权成功的方式包括依法维权、依理维权、联动维权、联合维权、工会领导负责维权、党委和政府支持维权和被动维权等,这些方式属于调解,不属于协商、仲裁和诉讼。市、区、县总工会的维权与其他类型工会的维权相比,具有自身优势,但也有可能转化为弊端。
Trade union rights law enforcement has legal and policy basis, but under the current circumstances, municipal, district and county general unions face the plight of helping employees safeguard their rights according to law. The rights protection of the general unions in cities, districts and counties has its own advantages compared with those of other types of trade unions, but it may also turn into disadvantages.
