电子通信的特殊性决定了传统合同法有关错误的规则很难直接适用于电子环境,也决定了电子订约错误专门立法的必要性。为了适应这一特殊性并为发生电子订约错误的当事人提供一定的救济,作为电子商务领域现今唯一的国际公约,《国际合同使用电子通信公约》(UECIC)不仅大胆尝试对电子错误进行专门规定,而且还对部分传统合同法规则进行了一定程度的创新和突破。2006年7月6日,中国政府签署了该公约。①我国合同法应当借鉴相关立法以促进电子商务的飞速发展。
The particularity of electronic communication determines that the rules of the traditional contract law concerning errors are hard to apply directly to the electronic environment and also determine the necessity of special legislation on electronic contractual errors. In order to adapt to this particularity and provide certain relief to the parties involved in the electronic contractual error, as the only international convention in the field of electronic commerce today, the UECIC not only boldly tries to make special provisions on electronic errors , But also some of the traditional rules of contract law to a certain degree of innovation and breakthrough.
