十八大以来,我国反腐倡廉建设正如火如荼进行,但在预防公务员贪污受贿方面,所采取的措施,成效有限。新兴的强制信托制度是预防公职人员腐败的一项重要措施,有助于增强社会对官员的监督,目前部分国家及地区已经实行,但我国尚未存在。与公务员财产公开制度相比较,强制信托将更加具有成效,主要体现在强制信托的预防性,强制性以及独立性等方面,能够有效解决我国公职人员在私人财产投资和国家利益冲突的问题,保证政府官员的合法经济利益,也保障公职人员将更多精力放在为人民服务并创造更多的社会价值。本文将针对我国在这一制度上的空白点,通过参照各国的强制信托制度,结合我国当下的国情,同时将财产公开制度与强制信托制度做比较,并借鉴财产公开制度的审核程序、申报范围等多方面优点,提出符合我国国情的、完善的强制信托制度的建议。对我国公职人员强制信托制度的构建提出多方面的建议和方案,包括适用对象、适用范围、对受托机构及信托当事人的规定、信托财产的管理及处分等。

This article will address our country’s blank point in this system, by referring to the compulsory trust system in each country, combined with the current national conditions in our country, at the same time comparing the public property system with the compulsory trust system, and drawing on the procedures for the examination and disclosure of property disclosure system Many advantages, put forward in line with China’s national conditions, and improve the compulsory trust system recommendations. Propose various proposals and proposals for the compulsory trust system of public servants in our country, including applicable objects, scope of application, provisions for trustee agencies and trust parties, management and disposal of trust property and so on.
