《物权法》肯定了拍卖的法律地位,提高了交易安全,明确了保护措施,强调了规范运作一、《物权法》肯定了“拍卖”这种交易方式的法律地位,且扩大了拍卖标的的类型范围在《物权法》颁布以前,我国的不动产交易是以登记为准。例如在《城市房地产管理法》、《土地管理法》及相关法规中规定,不动产交易非经登记不仅不能对抗第三人,而且在当事人之间也不发生法律效力。而《物权法》第15条明确规定,不动产拍卖的成交确认书作为不动产交易的合同,一旦签署,即刻生效。
