沉默权制度源自于“米兰达”规则,他赋予了被追诉者“不被强迫作不利于他自己的证言或强迫承认犯罪”的权利。此制度一方面有效地保障了被追诉者的人权,但同时一定程度上损害被害人的权益。如何更好地确立犯罪嫌疑人、被告人的沉默权,既是我国不断改革和完善刑事诉讼制度的需要,也是顺应民主、文明的发展趋势。
The system of right to silence stems from the “Miranda” rule, which gives the person being prosecuted “the right not to be forced to testify against him or to forcibly confess the crime.” On the one hand, this system effectively guarantees the human rights of the prosecutors, but at the same time, it damages the rights and interests of victims. How to better establish the suspect’s and the defendant’s right to silence is not only the need of our country to constantly reform and perfect the criminal procedure system, but also complies with the development trend of democracy and civilization.
