从美国、澳大利亚和和欧盟及其成员国的立法和司法实践可以看出,听觉商标和其他视觉商标一同被法律保护。我国新修改的《商标法》并没有对听觉商标的保护作出规定,但是随着科技的发展和人民生活水平的提高,音像制品业的迅猛发展,用声音作为商标也将会势在必行的。这样是听觉商标与视觉商标的特征、功能和构成一致性的必然结果。
As can be seen from the legislative and judicial practices of the United States, Australia, the European Union and its member states, auditory marks and other visual marks are protected by law. China’s newly amended “Trademark Law” does not provide for the protection of auditory marks, but with the development of science and technology and improvement of people’s living standards, the rapid development of audio-video products industry, the use of sound as a trademark will also be imperative . This is the inevitable result of the consistency of auditory marks and visual marks in their features, functions and composition.
