《中华人民共和国公务员法》经十届人大十五次会议审议通过,自2006年1月1日起开始实施。这部法律的制定和颁布,是我国社会主义民主与法制建设的一件大事,是干部人事工作历史上的里程碑。它将取代已在我国实施近12年的《国家公务员暂行条例》,成为我国第一部带有干部人事管理总章程性质的重要法律。在学习这部法律的过程中,尤其是公务员法第一条,即有关公务员法的立法宗旨,作为这部法律制定的基点,对于领会公务员法的各项制度设计意图具有十分重要的意义。故就公务员法的六个方面立法宗旨加以浅析,使得一个拥有630多万公务员的国家从此开始走上“依法治官”的道路,这标志着我国干部人事管理进入了依法管理的新阶段。
The Law of the People’s Republic of China on Civil Servants passed the 15th Session of the Tenth National People’s Congress for review and approval and has been implemented since January 1, 2006. The enactment and promulgation of this law is a major event in the construction of socialist democracy and legal system in our country and a milestone in the history of cadre and personnel work. It will replace the Provisional Regulations on Civil Servants that have been in operation in our country for nearly 12 years and become the first major law of our country with the general constitution of cadre and personnel administration. In learning this law, especially the first civil servant law, that is, the legislative purpose of the civil servant law, as the starting point for the formulation of this law, is of great significance for understanding the design intent of various systems of civil servant law. Therefore, analyzing the six purposes of the civil servant law to make a brief analysis, a country with more than 6.3 million civil servants has since embarked on the path of “administering the government according to law”, marking a new stage in the administration of cadres and personnel in our country in accordance with the law.
