非洲法①在比较法中有自己的位置吗?提出这样一个问题,乍看起来荒唐,会激起某些人的反感,并令很多对非洲法律和制度感兴趣的非洲或西方学者感到惊奇。但这个问题并没有现成的答案。今日的比较法会谈给我们提供了一个非常好的契机,让我们能够思考非洲法的现状以及非洲法自立为模式的能力。换言之,非洲法模式能否产生与其他外国法模式相比较的规范、概念或理论,并凸显自我之特色、恰当性及意义呢?非洲法于比较法之地位问题就从属于这些问题,
African law ① Has its place in Comparative Law? To put forward such a question at first glance absurdly would provoke some people’s resentment and surprise many African or Western scholars interested in African law and institutions. But there is no ready-made answer to this question. Today’s comparative law talks provide us with a very good opportunity to think about the status quo in African law and the ability of African law to become a model. In other words, can the model of African law produce norms, concepts or theories that compare with other models of foreign law and highlight the characteristics, appropriateness and significance of the self?
