刑事和解制度,又称加害人与被害人的和解(victim-offender-reconciliation,简称VOR)制度,一般是指在犯罪后,经由调停人的帮助,使加害者和被害者直接相谈、协商,解决纠纷或冲突的一种刑事司法制度。其目的在于恢复被加害人所破坏的社会关系,从精神和物质上弥补被害人所遭受的伤害,以恢复加害人与被害人之间的关系,并有利于加害人的改过自新和复归社会。
The system of criminal reconciliation, also known as victim-offender-reconciliation (VOR) system, generally means that after the crime, through the mediator’s help, the victimizer and the victim talk directly, negotiate and resolve A criminal justice system that disputes or conflicts. Its purpose is to restore the social relations destroyed by the perpetrators, to make up for the victims’ psychological and material harm so as to restore the relationship between the perpetrators and the victims and to help the perpetrators change their lives and return to the society.
