抗诉作为民事检察监督的法定形式,近20年的发展历程中,在历经小高峰后其抗诉数量一直呈下降趋势,从一个侧面说明抗诉影响力的下降。抗诉这一监督方式使用减少的背后是民事抗诉制度面临着一些理论阻隔,不管是抗诉前提的假象性,还是抗诉对司法独立、私权自治的冲击,这些都是影响抗诉制度发挥的因素。
As a statutory form of civil procuratorial supervision, protesting over the past 20 years has seen a downward trend in the number of protests after a small peak, illustrating the declining influence of protest from one aspect. Behind the reduction in the use of this method of supervision is that the civil protest system is facing a number of theoretical barriers, whether it is the illusion of the precondition of protest or the impact of the protest on the independence of the judiciary and the autonomy of private ownership, all of which are the factors influencing the protest system.
