进入21世纪以来,全国各地先后制定了200多部问责规范,其规模在2008年达到高峰。这些数量庞大的问责规范,无论是在规范的层级、颁布的机构与规范的名称方面,还是在问责事项和问责对象方面,都普遍存在诸多不统一,甚至矛盾与冲突之处,这反映实践中存在一种因人、因事、因时、因地而选择性规范的现象。这种规范上的选择性又进一步加剧了实践中本已普遍存在的选择性问责倾向,从而导致问责的法制化与法治化之间发生严重的张力。
