劳动争议案件的大幅增加给各级法院特别是基层法院带来巨大的压力,这种压力不仅来源于工作量的增加,更来源于维护社会稳定的大局观。面对巨大的压力,在“能动司法”的理念指导下,基层法院建立了劳动争议司法提前介入制度,中、高级法院纷纷制定指导意见以回应金融危机对我国劳动关系的冲击。各级法院的能动措施对解决劳动争议、缓解企业在金融危机中的压力确实起到一定的作用,但是对其导致的消极后果和溢出效应应当保持足够的警惕。由于法律相对社会情境的滞后性,法院确有必要以积极和能动的方式回应社会需求,但是无论如何,法院都要以“司法”的方式,而不是行政或立法的方式来回应不断变化的社会情境。
The drastic increase in cases of labor disputes has brought tremendous pressure on courts at various levels, especially grass-roots courts. Such pressure stems not only from an increase in the workload but also from the overall picture of maintaining social stability. Faced with tremendous pressure, under the guidance of the concept of “active judicial”, grassroots courts have established an early intervention system for judicial work on labor disputes. Both the medium and high courts have formulated their own guidelines in response to the impact of the financial crisis on the labor relations in our country. Active measures at all levels of courts have indeed played a role in resolving labor disputes and alleviating the pressure on enterprises in the financial crisis, but they should be vigilant against the negative consequences and spillovers they cause. Due to the lagging nature of the relative social situation of law, it is indeed necessary for courts to respond to social needs in a positive and dynamic way, but in any case, courts should respond to changing situations in a “judicial” rather than administrative or legislative manner Social situation.
