日本和平宪法虽然源自联合国占领军总司令部,但其修改与通过的过程表明,战后获得了主权者地位的日本民众在立宪过程中仍然发挥了不容忽视的作用。该宪法作为社会契约的体现,对政府和民众双方都有普遍的约束力。另外,和平宪法高扬和平主义的旗帜,同时又具有高度的现实性,在人类历史上具有划时代的意义。从历史和理论的角度来看,改宪论者对和平宪法的各种批判都面临着逻辑上的根本困难
Although Japan’s pacifist constitution originated from the headquarters of the United Nations Occupation Army, the process of its revision and adoption shows that the Japanese people who gained the status of sovereignty after the war still play an indispensable role in the constitutional process. As a manifestation of the social contract, the constitution is universally binding on both the government and the public. In addition, the pacifist banner of peace and pacification is at the same time highly realistic and has epoch-making significance in the history of mankind.
