隐私权作为一项公民权利,其实质在于公民可在法律范围内隐匿个人信息而不受外界非法干涉,是法治社会中公民的一项必不可少的人格权。但由于媒体职业权利和隐私权范围界定的相对模糊,现实中双方容易造成冲突。新闻媒体行业的特殊性,有时导致新闻媒体从业者,对报道对象的隐私权造成一定侵害。本文从健全我国法律体系及规范新闻媒体工作等角度,对如何平衡这种冲突进行探讨。
The essence of the right to privacy as a citizen is that citizens can hide personal information within the scope of the law without interference from the outside world and is an indispensable right of personality of citizens in a society ruled by law. However, due to the relatively vague definition of the scope of the media’s professional rights and privacy, in reality, both parties are likely to cause conflicts. The particularity of the news media industry sometimes causes news media practitioners to infringe on the privacy rights of the target audience. This article discusses how to balance such conflicts from the perspectives of improving our legal system and regulating the work of the news media.
