日本教育法学兴起于20世纪60年代,它以战后日本教育改革与教育法制建设成果为出发点,始于学界对国家教育政策的反思和检讨,最终依靠法学界与教育学界的共同努力而成为一门脱离于教育行政法的独立学科。日本教育法学会和《季刊教育法》等是其主要的研究载体,具有一定权威性。日本教育法学的关注焦点经历了只关注国家与国民之间的关系到关注国民内部关系的两个阶段。如今的日本教育法学承担着维护教育自由,批判教育保守主义的新任务。总的来说,日本教育法学是一门基于受教育权的权利法学。其发展历史呈现出鲜明的独立性、广泛的学科交叉性和丰富的实践性三大特点,对我国教育法学有着积极的借鉴意义。
Japan’s educational law emerged in the 1960s. Starting from the achievements of the post-war Japan education reform and education system, Japan’s educational law began with the reflection and review of the state education policy by the academic circles and finally became one by the joint efforts of law and education circles The door divorced from the independent discipline of education and administrative law. Japan Education Law Society and the Quarterly Education Law is its main research carrier, with some authority. The focus of Japanese education law has gone through two stages of focusing on the relationship between the state and the people and on the internal relations of the people. Today’s Japanese education law bear the new mission of safeguarding educational freedom and criticizing educational conservatism. In general, JCE is a right-based jurisprudence based on the right to education. Its history of development shows its distinctive independence, extensive interdisciplinarity and rich practicality, which have positive reference to China’s educational law.
