財產保全制度作為一種法律上的強制性措施,旨在防止有關當事人的財產被隱匿、轉移、變賣或者為了保存爭議標的物之價值,以保證將來發生法律效力的仲裁裁決得到切實執行。經當事人申請,有關機關可以對特定財產採取臨時性強制措施。現時,財產保全制度屬於中國民事訴訟法的一部份,但現時該制度在香港法例中分佈零散,並沒有具體章節明釋。本文將針對介紹中國和香港法律所記載的財產保全制度,將二者進行比較分析,望能得出相互能學習之處。
The property preservation system is a legal and mandatory measure aimed at preventing the property of the parties involved from being concealed, transferred, sold or in order to preserve the value of the object of the dispute so as to ensure the effective enforcement of the arbitration ruling legally effective in the future. Upon application by the parties concerned, the relevant authority may take temporary coercive measures on certain properties. At present, the property preservation system is part of the Civil Procedure Law of China. At present, however, the system is scattered in the laws of Hong Kong and there is no specific explanation. This article will introduce the system of property preservation recorded in the laws of China and Hong Kong and compare the two with each other, hoping to find out where each other can learn from each other.
