几乎所有的美国警匪片里,都有这样的对白:“你有权保持沉默,否则你所说的一切,都将在法庭上作为指控你的不利证据;你有权请律师,如果你雇不起,法庭将为你指定一位。”这样的对白被称为米兰达忠告(Miranda Warning)。在这一忠告的背后,是所有嫌犯的沉默权和律师帮助权。这一切都源于1966年的米兰达诉亚利桑那州案。
Almost all the American gangster films have a dialogue like this: “You have the power to keep silence, or everything you say will be in court as unfavorable evidence against you; you have the right to a lawyer if you hire The court will assign you one. ”" Such a dialogue is called the Miranda Warning. Behind this advice is the right of all suspects to silence and lawyers to help. It all came from Miranda v Arizona in 1966.
