顶岗实习因其岗位真实性,实操性让高职院校学生在工作实践中不可避免的存在劳动风险,现有的法律规范尚不能有效保障学生在顶岗实习中发生劳动风险时的正当权益。文章从校企合作人才培养的兴起,顶岗实习中学校、企业、学生的相互法律关系,顶岗实习存在的法律障碍和发展机遇等方面进行分析,通过厘清事实的来由,分析确认相关各方的权利义务,进而提出完善学生顶岗实习劳动权益保护相关法律规范的思路。
Due to the factuality and practicality of post-job internship, the vocational risks inevitably exist in the work practice of the students in vocational colleges. The existing legal norms can not effectively protect the legitimate rights and interests of students in the workplace risk of internship. The article analyzes the rise of college-enterprise cooperation talents, the inter-legal relationship between schools, enterprises and students, the legal barriers and development opportunities of internships, and so on. By clarifying the reasons, the author analyzes and confirms the rights of the parties concerned Obligations, and then put forward the idea of perfecting the laws and regulations on the protection of the rights and interests of laborers in positions and internships.
