目前在我国关于人民陪审员制度的讨论很多,但是关于该制度在基层法院的具体运作以及存在的问题没有十分详细的分析,本文主要从实践操作的层面,从分析目前审判实践中陪审员的产生程序、陪审员的培训事宜、陪审员经费的来源以及陪审员陪审案件补贴发放方式、陪审员的考核办法、陪审员参加案件审理及日常管理办法等实际现状入手,提出对目前陪审员制度的看法,从而提出完善人民陪审员监督制度的路径为:法院监督机制、用人单位配合监督机制、新闻媒体监督机制,三种方式只是对陪审员监督机制的具体构想设定,如果在监督的过程中发现了陪审员的任何问题,那么最终也需要对人民陪审员进行责任追究,而这个责任机制的建设将具有十分重要的意义。我相信如果陪审员的渎职行为已严重触犯刑法,那么相应的刑罚机制可以追究其责任,但是对于不能构成犯罪的,那么如何追究相应的责任则显得尤为重要。本文希望以此可以为今后我国人民陪审员制度的发展贡献些许力量。

If found in the process of supervision The jury any problem, then eventually also need to hold the people’s assessors accountability, and the construction of this responsibility mechanism will be of great significance. I believe that if the jury member’s dereliction of duty has seriously violated the criminal law, then the corresponding penalty mechanism can hold its responsibility, but for those who can not constitute a crime, then how to pursue the corresponding responsibility is particularly important. This article hopes to make a contribution to the development of our country’s people juror system in the future.
