物业管理中的法律纠纷较多,矛盾一直未能得以有效解决,其原因比较复杂。从根本上解决这一问题的关键是要明确物业管理活动中的主体及其相互之间的权利义务关系,目前我国物业管理立法中对相关主体的规定存在很多问题,必须进行重新构建。赋予住宅小区民事主体资格,明确其应有的权利和义务,在理论上可以与我国现行民事主体制度相容,在实践中可以有效解决物业管理中的许多矛盾和纠纷,在物业管理立法过程中可资考虑。
