个案急呈:杨某是一家证券公司的员工。2010年1月,他与公司签订了五年固定期限的劳动合同。2010年10月,因严重违反公司的劳动纪律,证券公司口头通知解除了杨某的劳动合同。对此杨某并无异议,但他认为公司应该出具解除劳动合同证明,证券公司没有答应。为此,杨某向当地劳动人事争议仲裁委员会申请仲裁,请求裁决公司为其出具解除劳动合同证明。
Case in an instant: Yang is a securities company employees. In January 2010, he signed a five-year fixed-term labor contract with the company. In October 2010, due to a serious violation of the company’s labor discipline, securities companies verbally notified the lifting of Yang’s labor contract. There is no objection to this Yang, but he believes the company should issue a certificate of termination of the labor contract, the securities company did not agree. To this end, Yang to the local labor and personnel dispute arbitration commission for arbitration, requesting the ruling company to issue proof of termination of their employment contracts.
