关于法的本质,马克思认为:法律是物质生产关系发展到一定阶段的必然产物,随着人类物质生产关系的发展归于消亡,其性质由经济关系决定,服从客观的经济条件。但这并不是说法律仅能对存在着的成熟的社会现象进行简单的表述。法律是对现实经济基础的反映,并不排斥依循经济基础的本质和统治阶级的利益进行超前型立法。超前型立法作为立法的一种 As to the essence of law, Marx holds that law is the inevitable product of the development of the relationship of material production to a certain stage.
