我国当前的职业教育财政投资法律救济存在诸多问题:理论和实践不相适应、法律救济实体设置的缺陷、法律救济程序设置的缺陷、法律救济对政府的问责制缺失。为此,职业教育财政投资法律救济可从以下方面进行思路创新:法律救济范围应逐步扩大;法律救济的程序应明晰化;健全法律救济的司法制度;强化职业教育财政投资救济的监督管理机制等,以确保职业教育财政投资经费到位。
