2011年以法国为首的北约依据联合国安理会第1973号决议对利比亚实施以大规模的空袭与军事打击为形式的人道主义干涉。引发了国际社会对人道主义干涉的激烈争论。本文从利比亚事件入手,通过讨论人道主义干涉的合法性,对国际法原则的冲击这两方面来分析利比亚事件中人道主义干涉的性质。重点分析了人道主义干涉在利比亚实施过程中存在的问题,主要有安理会缺乏国际势态判断制度,其决策制度不完善和对北约追责难以实现。最后,针对这些问题提出相应的法律建议。
In 2011, NATO, led by France, conducted Libya’s humanitarian intervention in the form of massive air strikes and military strikes in accordance with UN Security Council Resolution 1973. Triggered a fierce debate in the international community over humanitarian intervention. This article starts with the Libya incident and analyzes the nature of humanitarian intervention in Libya by discussing the legitimacy of humanitarian intervention and the impact on the principles of international law. It mainly analyzes the problems existing in the process of humanitarian intervention in Libya, mainly because the Security Council lacks the international judgment system, its decision-making system is imperfect and the pursuit of NATO can not be realized. Finally, put forward corresponding legal advice on these issues.
