行政追偿制度是现代行政法的一项重要制度,它能够增强行政机关工作人员的责任意识,促使公务员尽职尽责、依法行政。但我国的这一制度设计过于原则,缺乏系统完善的规定。学界对此似乎也关注不多。本文试图对我国行政追偿存在的主要问题进行分析并提出相应建议。 Administrative recovery system is an important system of modern administrative law. It can enhance the sense of responsibility of administrative staff and urge civil servants to exercise due diligence and administration according to law. However, the design of this system in our country is too principled and there is a lack of well-established rules. The academic circles seem to pay little attention to this. This article attempts to analyze the main problems in China’s administrative recovery and put forward corresponding suggestions.
