ADR即代替性纠纷解决方式,目前在我国越来越多的被介绍和应用,在各个纠纷领域也日益显示出它的独特作用。其中,法院附设ADR是根据主持纠纷解决主体而不同于其他ADR类型的一种纠纷解决形式,这种制度虽然属于诉讼外纠纷解决方式,但与法院的诉讼程序有一种制度上的联系,尤其是其中的法院附设调解制度与我国的法院调解制度是两个看似相似,但在内涵上却存在着极大差别的制度。本文通过对海峡两岸法院调解制度的比较,厘清了在制度设计上的正确认识。
ADR is an alternative dispute resolution method. At present, more and more ADRs are introduced and applied in our country, and their unique roles are increasingly shown in various disputes. Court-affiliated ADR is a form of dispute resolution that is different from other ADR types according to the subject of dispute resolution. Although such a system belongs to the dispute settlement method outside the lawsuit, it has an institutional connection with the litigation procedure of the court. In particular, The adjudication system of the court and the court mediation system in our country are two similar systems, but there is a great difference in content. Through the comparison of the mediation system between the two sides of the Taiwan Strait, this article clarifies the correct understanding of the system design.
