所谓知识产权质押贷款,指的是企业或个人以自身拥有的商标、专利、版权等知识产权作为质押物,从银行类金融机构获得贷款的一种信贷产品。近几年来,在金融生态环境相对较好的地区,知识产权质押贷款业务推进较为顺利。以北京市为例,仅2009年度全市金融机构知识产权质押贷款总规模就已突破6亿元。然而,这项业务整体发展的情况却不如人意。究其原因,知识产权质押贷款存在的法律风险是一大阻碍。知识产权质押贷款面临的法律风险我国于1995年颁布的《担保法》第75条规定,“依法可以转让的商标专用权、专利权、著作权中的财产权可以质押”;2007年3月通过的《物权法》第223条也规定,“可以转让的注册商
The so-called intellectual property pledge loan, refers to the enterprise or individual with its own trademarks, patents, copyrights and other intellectual property as a pledge to obtain loans from bank financial institutions, a credit product. In recent years, the intellectual property pledged loan business has been proceeding smoothly in areas with relatively good financial environment. Take Beijing as an example, only the total scale of intellectual property pledged loans of financial institutions in 2009 exceeded 600 million yuan. Legal Risks Facing Pledge Loans of Intellectual Property Article 75 of the Guarantee Law promulgated in China in 1995 stipulates that ”property rights in trademarks, patent rights and copyrights that may be transferred according to law may be pledged“; adopted in March 2007 Section 223 of the Property Law also stipulates that ”registrars that can be transferred."
