集装箱超期使用费,又称滞箱费,是指在海上货物运输过程中,承运人提供集装箱运输货主的货物,在此过程中,承运人从加速流转,增强效率的角度出发,往往会与货主约定免费使用集装箱的期限,货主需在此期限内归还集装箱,否则对于逾期归还的行为,承运人有权收取一定的费用。在现今的航运实践中,集装箱超期使用费普遍存在,并已形成一种行业惯例,但是出现了很多的纠纷。文章试图从集装箱超期使用的法律性质、收取标准及诉讼时效起算点等角度加以阐述分析,以期在未来,航运业能建立更完善具体的集装箱使用制度,在世界经济贸易往来中发挥更大的作用。
