农民住房财产权抵押贷款是推进农村金融改革,探索农民财产权实现的一种新路径。因长期囿于我国严格的土地管理制度,农民住房财产权抵押的实现面临法律和制度的双重困境。在当今的社会背景下,构建农民住房财产权抵押制度应在土地“两权分离”的原则下,尽快推进农村土地和房屋的确权登记工作,在试点地区放宽小产权房入市政策,允许城镇居民购买农村住房。
The peasant housing property right mortgage loan is a new way to promote rural financial reform and explore the realization of peasant property rights. For a long time in our country’s strict land management system, the realization of peasant’s housing property right mortgage faces the double dilemma of law and system. In today’s social context, building a peasant housing property rights mortgage system should be the land “separation of powers ” principle, as soon as possible to promote the right to rural land and housing registration, the pilot area to relax the small property market entry policy to allow Urban residents buy rural housing.
