作为生存性智慧视阈下的一种地方性知识,民族习惯法是“默会知识”、“互惠知识”和“实践知识”的集合。族群成员倾向于选择民族习惯法作为纠纷解决模式,内因是其契合族群社会的生活逻辑和行为规范,外因是国家法律的虚无主义和功利主义对族群社会常规性交往逻辑的背离。因而,认真对待民族习惯法,不仅增益于国家的科学立法,亦可增益于民族地区法治现代化的理性建构。
As a kind of local knowledge under the threshold of survival wisdom, national customary law is a collection of “tacit knowledge”, “reciprocal knowledge” and “practical knowledge”. Ethnic group members tend to choose national customary law as the mode of dispute resolution. The internal reason is that they conform to the life logic and code of conduct of ethnic group society. The external cause is the deviations from the conventional logic of ethnic society by nihilism and utilitarianism of national law. Therefore, treating the customary national law seriously will not only benefit from the state’s scientific legislation, but also benefit from the rational construction of the modernization of the law in the ethnic areas.
