1999年11月15日,中美就中国加入世界贸易组织达成双方协议,这是一个具有重大现实意义和深远历史意义的事件。这一协议的签署将有利于中国入世进程,有利于改革开放和现代化建设事业,并将为世界经济的发展与变革注入新的活力。与贸易有关的知识产权协议(以下简称Trips协议)是世界贸易组织中一个极为重要的协议。它对入世后的中国知识产权审判必将产生重大的挑战与影响。本文将简要回顾和探讨与贸易有关的知识产权协议的背景、若干法律问题及入世后的对策与建议。
On November 15, 1999, China and the United States reached an agreement on both sides regarding China’s accession to the World Trade Organization. This is an event of great practical significance and far-reaching historical significance. The signing of this agreement will be beneficial to China’s accession to the WTO, be conducive to reform, opening up and the cause of modernization and will inject new vitality into the world’s economic development and transformation. The TRIPS Agreement (hereinafter referred to as the Trips Agreement) is an extremely important agreement in the WTO. It is bound to have major challenges and influences on China’s trial of intellectual property after its accession to the WTO. This article will briefly review and explore the background of the TRIPS agreement, several legal issues and the suggestions and measures after WTO accession.
