本文从法律设计制定的层面对我国宅基地相关法律规定进行了阐述和分析,探讨了各地对宅基地流转政策的一些探索性突破。文中指出宅基地的法律规定应以农民根本利益为出发点,可控情况下适当尝试有序开放,兼顾经济发展的可持续性并保障法律的严肃性。 This article elaborates and analyzes the relevant laws and regulations of homestead in our country from the aspect of legal design and development and probes into some exploratory breakthroughs in the policies of circulation of homestead. The article points out that the law of house sites should start from the peasants’ fundamental interest, properly try to be open in an orderly manner under the controllable circumstances, give consideration to the sustainability of economic development and guarantee the seriousness of the law.
