在当下中国,随着社会经济发展与人们法律意识的提高,出现了越来越多的行政纠纷需要进行实质性解决。但现实情况却是行政复议老百姓觉得是官官相护,缺少公平公正;而行政诉讼却是门槛太高,实施不易,还有一种“民不与官斗”的思想在制约,使之不愿不敢不能提起“民告官”这种“大逆不道”的行政诉讼,而信访作为一种解决纠纷的手段大受欢迎,涉诉信访屡见不鲜,有时会因为一些原因而引发更加激烈的社会矛盾。那么如何构建一种让老百姓既觉得公平公正又具有十分的可接受性的行政纠纷化解机制是当下构建多元化矛盾化解体质的重点。本文提出了化解行政纠纷的第四条道路——新型行政调解制度。文章将从我国目前的行政纠纷化解现状及存在的问题出发,由此阐述构建新型行政调解制度的必要性,然后分析该制度的定位、目标、办事原则、受案范围、组织结构与人员构成、具体工作实施流程、调解效力以及这种新型行政调解的司法确认以赋予其强制执行力的措施与办法。
In today’s China, with the development of society and economy and the improvement of people’s legal awareness, more and more administrative disputes have emerged and require substantive solutions. However, the reality is that the people in administrative reconsideration think that it is the government officials and the lack of fairness and justice. However, the administrative lawsuits are too high barriers, not easy to implement, there is a kind of “ Dare not to mention ”people sue official “ this ”overwhelming " administrative litigation, and petition as a means of settlement of disputes is welcome, petition letters and accusations are not uncommon, and sometimes for some reason and lead to more intense society contradiction. So how to build a kind of administrative dispute resolution mechanism that makes people feel fair, just and acceptably fair is the key to build a pluralistic contradiction and resolve the constitution. This article proposes the fourth road to resolve administrative disputes - a new administrative mediation system. The article will start with the current situation of the settlement of administrative disputes in our country and the existing problems, and then expounds the necessity of constructing a new type of administrative mediation system. Then it analyzes the system’s positioning, objectives, working principles, the scope of acceptance, organizational structure and personnel composition, The implementation of specific work processes, the effectiveness of mediation and judicial confirmation of this new type of administrative mediation to give them enforcement measures and methods.
