家务劳动补偿制度是指在婚姻关系存续期间,一方在抚养教育子女、照顾老人以及对另一方工作或学习等方面付出较多义务的,有权请求另一方经济补偿的制度。这一制度具有现实的经济价值和社会价值。我国婚姻法也分别从共同财产分割中的照顾女方原则及分别财产中的补偿请求原则两方面体现了这一制度,但是在立法上存在着适用范围较窄、适用时间严格以及法律规定较为宽泛等缺陷。本文试结合其他国家和地区的相关立法例,针对上述缺陷提出改进的建议,以期更好地实现这一制度所到达到的目的。
Domestic labor compensation system refers to the system of claiming the other party’s financial compensation during the existence of a marriage between one party paying more obligations in raising children, caring for the elderly and working or studying in the other party. This system has realistic economic value and social value. The Marriage Law of our country also embodies this system from the principle of taking care of women in common property division and the principle of compensation claim in separate property. However, there are some shortcomings in the legislation such as narrow scope of application, strict application of time and more general legal provisions . This article, combined with the relevant legislation in other countries and regions, puts forward suggestions for improvement based on the above defects so as to achieve the goal of this system.
