近年来国内食品安全事件频发,暴露了我国食品安全规制设计工作的不足与弊端,因此有必要加强我国食品安全规制水平,有效地保障我国食品行业的知识产权。现阶段,我国食品安全领域对知识产权的关注度普遍较小。本文立足于知识产权语境,结合实例论述了知识产权与食品安全的联系、对我国的相关食品安全法规进行了解读,并对我国食品安全规制存在的问题及建设基于知识产权保护的食品安全规制方法进行了阐述,提出了一些对应的解决方法,以期推动基于知识产权保护的食品安全规制设计工作的发展。
In recent years, the frequent occurrence of domestic food safety incidents exposed the shortcomings and drawbacks of China’s food safety regulatory design work. Therefore, it is necessary to strengthen the level of food safety regulation in our country and effectively protect the intellectual property rights in China’s food industry. At this stage, our country’s food safety area of concern about intellectual property is generally small. Based on the context of intellectual property, this article discusses the relationship between intellectual property and food safety, and explains the relevant food safety regulations in our country. It also analyzes the existing problems of food safety regulation in our country and the construction of food safety regulations based on intellectual property protection Methods, and put forward some corresponding solutions to promote the development of food safety regulatory design based on the protection of intellectual property.
