【裁判要旨】食品安全法和《食品生产加工企业质量安全监督管理实施细则》对于未获得生产许可证而从事食品生产行为都有明确的处罚规定,但前者系由全国人大常委会制定的法律,而后者则是由国家质量监督检验检疫总局制定的部门规章,故应适用食品安全法的规定。我国对食品生产实行目录式许可制度,企业应当在食品生产许可的品种范围内从事食品生产活动,不得超出许可的品种范围生产食品。依照食品安全法的规定,企业超出许可范围生产食品的,属于未经许可从事食品生产经营活动,除没收违法所得、违法生产经
