儒学作为封建官方哲学在西汉还处于逐渐形成、不断巩固的阶段,而西汉法制基本格局的奠定则远远早于西汉儒家官方哲学的诞生,这就决定了儒家哲学对西汉法制的影响只能是间接的和局部渗透的。但是,就整个中国封建社会而言,儒家官方哲学对法制的影响则是极为深远的,并且,越到后来,随着儒家学说作为政治统治思想的地位日益巩固,它时封建法制的渗透也越来越深、越来越广。而回过头来,单以“德主刑辅”与封建五刑在西汉立法中没有得到正式确认,亦可看出儒家学说在当时确实尚未成为统治阶级进行立法的根本指导思想。
