善意取得制度在市场经济中发挥着保护交易安全和维持市场经济秩序的作用,它是指行为人将其无权处分的他人财产转让给买受人,如果买受人在取得财产时主观上是善意的并支付相应对价,就可以取得该财产的所有权,原财产真正所有权人就不能向买受人要求返还财产,只能要求无权处分人承担赔偿责任。我国《物权法》规定善意取得制度可以适用于不动产物权,本文旨在通过对不动产善意取得制度构成要件展开分析,以促进不动产善意取得制度在我国的运用和发展。
The system of good faith acquisition plays a role in market economy in protecting the transaction security and maintaining market economic order. It means that the perpetrator transfers the property of another person whom he is not entitled to dispose of, to the buyer. If the buyer acquires the property subjectively Goodwill and pay the appropriate price, you can obtain the ownership of the property, the original owner of the real property can not ask the buyer to return the property, can only claim no right to punish those who assume liability. China’s “Property Law” provides that the system of good faith acquisition can be applied to the real right of real property. The purpose of this paper is to analyze the constitutional elements of good faith acquisition of real estate so as to promote the application and development of the system of bona fide acquisition of real property in our country.
