17— 18世纪 ,不平等条约概念曾经为西方国际法的经典作家们所讨论 ,但是在 19世纪被遗忘。2 0世纪以后不平等条约概念的复活 ,是从中国开始的。 190 6年 ,以孙中山为首的同盟会革命党人 ,在深刻理解国家主权平等原则的基础上 ,提出不平等条约概念。第一次世界大战之后 ,国家主权平等原则在一定程度上得到弘扬 ,带动了中国人使用不平等条约概念。不平等条约概念真正在中国广泛使用 ,是在国民革命兴起的过程中 ,而孙中山在其中发挥了至为关键的作用。不平等条约概念是孙中山留给 2 0世纪中国的一笔重要的遗产。
In the 17th and 18th centuries, the concept of unequal treaties was discussed by the classical writers of western and international law, but was forgotten in the 19th century. The revival of the concept of unequal treaties after the 20th century began with China. In 1960, on the basis of a profound understanding of the principle of equality of state sovereignty, the alliance reformist revolutionaries headed by Sun Yat-sen proposed the concept of unequal treaties. After World War I, the principle of the sovereign equality of nations was promoted to some extent and led the Chinese to use the concept of unequal treaties. The concept of unequal treaties is really widely used in China during the rise of the National Revolution, in which Sun Yat-sen played a crucial role. The concept of unequal treaties is an important legacy that Sun Yat-sen left for China in the 20th century.
