在中,笔者着重对福果案后各方学说的见解做了简单介绍并提出笔者对其的否定观点,指出要发现反致的价值,应从运用反致预达到的目标下手,在新的价值取消的指引下,找到反致最终的导向,本文便具体阐述实践反致制度的具体构想.
