物业管理与业主的生活密切相关,管理效果将直接影响到业主的生活质量。自《物权法》颁布以来,我国法律开始关注业主权益,并让物业管理服务有了初级标准。然而《物权法》及相关法律对于业主权利的保护并不完善,其中多项规定过于简单、粗略,造成业主权利时常受到侵犯,引发业主与物业管理企业矛盾升级。本文针对物业管理中业主权利的有效保护进行研究,目的是为我国相关法律进一步完善提出合理建议,希望这些法律能够更好地保护业主权利。
Property management and the owner’s life are closely related to the management effect will directly affect the quality of life of the owners. Since the “Property Law” promulgated, our law began to pay attention to the rights and interests of owners, and property management services to have a preliminary standard. However, the “Property Law” and related laws for the protection of the rights of owners is not perfect, many of which are too simple and rough rules, resulting in the owners often violated the rights, triggering the owners and property management contradictions escalation. This article aims at the effective protection of the owners’ rights in the property management. The purpose is to put forward reasonable suggestions for the further improvement of the relevant laws in our country, and hope that these laws can better protect the rights of the owners.
