在商标法理论研究中,学界对商标权客体的认识存在误区,普遍将商标权的客体错误界定为商标标识或商标,由此造成了商标法理论和司法实践中的诸多缺陷。商标权的客体既不是商标标识也不是商标标识与商品类别的综合体,而是商标标识与特定种类商品间的纽带关系。正确界定商标权客体不仅能为科学构建商标侵权理论提供基础,而且还能很好地解释商标法诸多理论问题
In the study of the theory of trademark law, there is a misunderstanding of the object of trademark rights in the academic circle, and the object of trademark rights is generally wrongly defined as the trademark mark or trademark, thus resulting in many defects in the theory of trademark law and judicial practice. The object of the trademark right is neither a trademark nor a composite of a trademark and a commodity, but a link between a trademark and a specific type of commodity. Correctly define the object of trademark rights can not only provide a scientific basis for the construction of trademark infringement theory, but also can well explain many theoretical issues of trademark law
