随着国外绩效评估的广泛运用与开展,绩效理念以及评估方法便开始引入我国,并在立法领域萌芽发展,走向社会实践。立法具有动态属性,一直以来国家都在强调打造“立、改、废”三位一体的立法过程,然而一些部委和地方政府注重立法数量、轻视立法质量的取向彰明较著。面对大幅度增加的立法数量、日新月异的社会变迁,立法质量就出现了不可回避的短板问题。本文针对立法后评估这一专题,详细阐述其概念、主体、对象、内容等,并通过分析现阶段国内外立法后评估的现状和不足,提出自己的观点。
With the extensive application and performance of foreign performance appraisal, the concept of performance and the appraisal method have begun to be introduced into our country, and they have sprouted in the field of legislation and become social practice. However, some ministries and local governments pay more attention to the quantity of legislation and neglect the orientation of legislation quality, so the legislation has the dynamic character all the time. Faced with the drastically increased number of legislatures and the ever-changing social changes, there has been an unavoidable short-board issue in the quality of legislation. This article aims at the post-legislative assessment of this topic, elaborates its concept, subject, object, content, etc., and puts forward my point of view by analyzing the current situation and deficiencies of post-legislative evaluation at home and abroad.
