研究习惯法正成为一个热门的研究点,越来越多的学者意识到习惯法研究的重要性。然而习惯法研究的历史毕竟较为短暂,研究的方向虽然众多,学者追逐研究热点导致研究成果分散,而缺乏宏观体系的构建,因此造成习惯法研究体系上的缺陷。本文在梳理我国法学界对习惯法研究所存在问题的基础上,进一步分析问题产生的原因及解决对策。 The study of customary law is becoming a hot research topic, and more and more scholars are aware of the importance of the study of customary law. However, the history of customary law research, after all, is relatively short. Although the research direction is numerous, the scholars chase the research hotspots, leading to the scattered research results and the lack of macroscopic system construction. On the basis of combing the existing problems of customary law research in China’s jurisprudence, this article further analyzes the causes of the problems and their countermeasures.
